MP Building Permission Rules: MP में बिल्डिंग परमिशन सिस्टम का बड़ा बदलाव; अब NOC के चक्कर खत्म, पूरा खेल ऑनलाइन—फाइल नहीं, सिर्फ़ डिजिटल दस्तावेज़ों से मिलेगा निर्माण की मंजूरी
MP Building Permission Rules: मध्य प्रदेश वासियों के लिए राहत भरी खबर (Relieving news for the people of Madhya Pradesh.) है। राज्य की मोहन सरकार ने भवन निर्माण अनुमतियों की प्रक्रिया को सरल (The Mohan government of the state has simplified the process of building permissions.) करते हुए एनओसी की बाध्यता समाप्त कर (Eliminate the requirement of NOC) दिया है। साथ ही आवेदन से मंजूरी तक पूरी प्रक्रिया ऑनलाइन (Additionally, the entire process—from application to approval—is online.) कर दी गई है। इस फैसले से नागरिकों (Citizens [affected] by the decision) , निवेशकों, डेवलपर्स एवं निर्माण एजेंसियों को प्रक्रियागत विलंब से राहत (Relief for developers and construction agencies from procedural delays) मिलेगी । साथ ही ईज ऑफ डूइंग बिजनेस (Along with Ease of Doing Business) को और मजबूती मिलेगी।
दरअसल, नगरीय विकास एवं आवास विभाग ने प्रदेश में भवन निर्माण एवं विकास अनुज्ञा प्रक्रिया (The Housing Department [has streamlined/addressed] the building construction and development permission process in the state.) को सरल व पारदर्शी बनाने की दिशा में महत्वपूर्ण सुधार लागू किए (Implemented significant improvements in the direction.) हैं। अपर मुख्य सचिव संजय दुबे द्वारा जारी निर्देशों के अनुसार, अब भवन निर्माण अनुज्ञा प्रकरणों में विभिन्न विभागों से अनावश्यक रूप से मांगे (Now, in building construction permission cases, unnecessary demands are being made from various departments.) जाने वाले अनेक अनापत्ति प्रमाण-पत्रों की बाध्यता समाप्त (Requirement for multiple No-Objection Certificates (NOCs) abolished.) कर दी गई है। सहकारिता विभाग एवं गृह निर्माण सहकारी समितियों (Cooperation Department and Housing Construction Cooperative Societies) , विद्युत तथा नजूल विभाग से मांगी जाने वाली कई प्रकार की अनापत्तियों की अनिवार्यता भी समाप्त (The requirement to obtain various types of No Objection Certificates (NOCs) from the Nazul Department has also been abolished.) कर दी गई है।
नई व्यवस्था के प्रमुख बिंदु
- भवन अनुज्ञा की पूरी प्रक्रिया ऑनलाइन (The entire building permit process is online.) होगी।
- आवेदन, नक्शे एवं अन्य दस्तावेजों की केवल डिजिटल प्रतियां ही स्वीकार (Only digital copies of other documents will be accepted.) की जाएंगी ।
- किसी भी स्थिति में हार्ड कॉपी प्रस्तुत करने की आवश्यकता (Requirement to submit a hard copy in the given situation.) नहीं होगी।
- भूमि स्वामी द्वारा स्वयं आवेदन करने पर ऑनलाइन शपथ-पत्र लिया (An online affidavit was obtained upon the landowner applying personally.) जाएगा।
- अधिकृत कंसल्टेंट के माध्यम से आवेदन (Application through an authorized consultant) किए जाने पर भूमि स्वामी द्वारा हस्ताक्षरित शपथ-पत्र अपलोड करना होगा।
पर्यावरण/अग्निशमन के लिए
- निर्धारित क्षेत्रफल से अधिक के भवनों एवं परियोजनाओं में ही पर्यावरणीय अनापत्ति (Environmental clearance required only for buildings and projects exceeding the prescribed area.) आवश्यक होगी।
- वृक्ष कटाई की अनुमति भी केवल उन्हीं मामलों में आवश्यक (Permission for tree felling is also required only in such cases.) होगी, जहां वास्तविक रूप से वृक्षों की कटाई प्रस्तावित (Felling of trees is actually proposed.) हो।
- अग्निशमन अनापत्ति के संबंध में राष्ट्रीय भवन संहिता के प्रावधानों के अनुरूप व्यवस्था सुनिश्चित की (Arrangements were ensured in accordance with the provisions of the National Building Code regarding the fire safety No Objection Certificate (NOC).) गई है।
इन मामलों में NOC की पड़ सकती है जरूरत
विभाग ने स्पष्ट किया है कि एयरपोर्ट अथॉरिटी ऑफ इंडिया (The department has clarified that the Airports Authority of India…) (AAI), राष्ट्रीय स्मारक प्राधिकरण (NMA) तथा विरासत (Heritage) क्षेत्रों से संबंधित अनापत्तियों की आवश्यकता (Requirement of No-Objection Certificates (NOCs) related to the areas) अब केवल उन्हीं मामलों में होगी, जहां ऑनलाइन भवन अनुज्ञा प्रणाली (Online Building Permission System) में GIS आधारित सत्यापन के माध्यम से संबंधित भूखंड प्रभावित अथवा प्रतिबंधित क्षेत्र में स्थित (Based on verification, the concerned plot is located in the affected or restricted area.) पाया जाएगा। अन्य सभी मामलों में इन अनापत्तियों की आवश्यकता (These clearances are required in all cases.) नहीं होगी।
